Last updated: October 24, 2025
1. Introduction
We at NADIR MAWJI PHYSIOTHERAPY PROFESSIONAL CORPORATION DOING BUSINESS AS MUV THERAPY PHYSIO & SPORTS MEDICINE (“we”, “our”, “us”) value your privacy and are committed to protecting the personal information we collect when you choose to receive SMS/text message communications from us (the “SMS Service”). This SMS Privacy Policy explains how we collect, use, disclose, retain and protect your personal information in connection with our SMS Service.
By opting in to receive SMS messages from us, you acknowledge that you have read and understood this policy and consent to our collection, use and disclosure of your information as described herein.
2. Scope & Regulatory Framework
Our SMS Service is subject to Canada’s Anti-Spam Legislation (CASL) when we send commercial electronic messages (CEMs) via SMS.
We also comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) in relation to the collection, use and disclosure of personal information in the course of commercial activities.
Accordingly, we will only send you SMS messages if you have provided valid consent and we will provide clear identification and an easy opt-out mechanism in each message or as required.
3. What Personal Information We Collect
When you subscribe to our SMS Service, we may collect:
Your mobile phone number.
Your name (if provided).
Date and time of your opt-in.
Details of how and when you gave consent (for our records).
Preferences, if you provided them (e.g., frequency, types of messages).
Opt-out date/time when you unsubscribe.
We collect this information for the purposes described below.
4. How We Use Your Information
We use your personal information to:
Send you SMS messages you have consented to receive (for example: appointment reminders, wellness offers, clinic updates, promotions).
Record and manage your consent (including opt-in/opt-out records) to comply with CASL.
Analyse and improve our SMS Service and communication preferences.
Respond to your queries or requests regarding the SMS Service.
5. How We Disclose Your Information
We will not sell your mobile phone number or personal information. We may share your information:
With our service providers (such as our SMS platform provider, e-marketing system) who help us operate the SMS Service, provided they are bound by confidentiality and data-protection obligations.
If required by law, regulation, legal process, or to protect our rights or the rights of others.
6. Retention & Record-Keeping
We keep a record of your consent (opt-in/opt-out) and SMS message history for as long as is reasonably necessary to meet our business and legal obligations (including under CASL and PIPEDA). Where you unsubscribe, we will retain your “opt-out” record to ensure you are not further contacted by SMS.
7. Your Rights & Choices
Opt-Out / Unsubscribe: Every SMS we send will include a clear and simple unsubscribe mechanism (for example, “Reply STOP to unsubscribe”). Upon receiving your opt-out request, we will stop sending you SMS messages as soon as reasonably possible, and in any event within ten (10) business days.
Access / Correction: You may contact us to request access to the personal information we hold about you, or request corrections, as permitted by applicable law.
Withdrawal of Consent: You may withdraw your consent for our SMS Service at any time by following the unsubscribe instructions above. Withdrawing consent does not affect the lawfulness of prior processing based on consent before its withdrawal.
Quiet Hours & Message Frequency: While not legally required, we follow best practices by limiting SMS messages to reasonable times (e.g., between 9 a.m. and 9 p.m. local time) and disclosing approximate message frequency at the time of opt-in.
8. Consent Collection & Documentation
When you opt in to receive SMS messages, we will clearly indicate:
That you are consenting to receive SMS messages from us.
The purpose of those messages (e.g., appointment reminders, offers).
That message and data rates may apply (where relevant).
Instructions for how to unsubscribe.
We will keep records of when and how you provided consent and what you were told at the time (for example, via online form, paper form, verbally with log). This proof supports compliance under CASL.
9. Message Identification Requirements
Every SMS CEM we send will clearly identify:
Our business name (MUV THERAPY) or the name of any third party on our behalf.
A valid mailing address (or PO Box), and either an email address, web address or phone number at which you can contact us.
The unsubscribe mechanism as described above.
If the SMS has character-space constraints, we may include a link to our full identification/disclosure statement.
10. Exemptions & Transactional Messages
Some messages are exempt from the consent requirement under CASL if they are purely transactional or informational (for example: appointment confirmations, billing notices) and do not include promotional content.
Nevertheless, we still include identification and an unsubscribe mechanism where practicable, and handle your information in accordance with this policy.
11. Security
We take reasonable organizational, technical and administrative measures to safeguard your personal information from unauthorized access, use, disclosure or modification. However, no method of transmission over the Internet or electronic storage is 100 % secure, so we cannot guarantee absolute security.
12. Changes to This Policy
We may update this SMS Privacy Policy from time to time. When we do, we will revise the “Last updated” date at the top and post the new version on our website. We encourage you to review it periodically. Your continued subscription to the SMS Service after the changes constitutes your acceptance of the revised policy.
